Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Pursely mobile application (the "Service") operated by 42DIGITAL ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By downloading or using the App, you agree to be bound by these Terms.

1. AI Fallibility and User Responsibility

Pursely utilizes advanced Artificial Intelligence (AI) to remove photo backgrounds, identify brands, and estimate secondary-market values. You acknowledge and agree that:

• AI Models Make Mistakes: The AI may misidentify a brand, improperly crop an image, or hallucinate pricing data based on limited visual input.
• Mandatory Verification: You are strictly responsible for reviewing and manually editing the accuracy of all extracted data (including brand names and purchase prices) before relying on it.

2. Consignment Quotes & Authenticity

The "Live Marketplace Quote" feature provides an automated estimate of a bag's potential secondary market value. This is a non-binding estimate. Any actual consignment payout is subject to physical receipt, professional authentication, and final condition review by third-party consignment partners. Pursely bears no liability if a third-party partner rejects an item or offers a lower payout than the App's estimate.

3. Affiliate Links Disclosure

The Service allows users to share "Whisper Links" to products on their Wishlist. You acknowledge that 42DIGITAL may utilize affiliate tracking parameters within these links. If a purchase is made through a Whisper Link generated by the App, we may receive a small commission from the merchant at no additional cost to the buyer.

4. User Content

You retain full ownership of the images and data you upload to the App. However, you agree not to upload illicit, illegal, or copyrighted material belonging to others to your public Closet Clubs.

5. Intellectual Property

The Service and its original code, features, and UX design are and will remain the exclusive property of 42DIGITAL. The Service is protected by copyright and trademark laws.

6. Limitation of Liability

In no event shall 42DIGITAL, nor its directors, employees, or partners, be liable for any indirect, incidental, special, or punitive damages resulting from (i) your access to or use of the Service; (ii) data loss or unauthorized access to your account; or (iii) financial loss resulting from reliance on AI-generated estimates or Insurance PDF exports.
